Welcome to ASCEND Fitness. These Terms of Service ("Terms") govern your use of the ASCEND mobile application ("App") and related services provided by ASCEND Fitness ("ASCEND," "we," "us," or "our").

Agreement: By downloading, installing, or using ASCEND, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Eligibility

To use ASCEND, you must:

  • Be at least 16 years of age

  • Have the legal capacity to enter into a binding agreement

  • Not be prohibited from using the App under applicable laws

By using ASCEND, you represent and warrant that you meet these eligibility requirements.

2. Account Registration

To access certain features, you may need to create an account. You agree to:

  • Provide accurate and complete information during registration

  • Maintain the security of your account credentials

  • Notify us immediately of any unauthorized access to your account

  • Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

3. ASCEND Pro Subscription

3.1 Subscription Plans

ASCEND offers premium features through ASCEND Pro subscriptions:

  • Monthly Plan: Billed monthly, cancel anytime

  • Annual Plan: Billed annually at a discounted rate

3.2 Free Trial

New subscribers may be eligible for a free trial period. At the end of the trial, your subscription will automatically convert to a paid subscription unless you cancel before the trial ends.

3.3 Billing

  • Subscriptions are billed in advance on a recurring basis (monthly or annually)

  • Payment is processed through your Apple App Store account

  • Prices are subject to change; we will notify you of price changes in advance

3.4 Cancellation and Refunds

  • You may cancel your subscription at any time through your App Store account settings

  • Cancellation takes effect at the end of the current billing period

  • No refunds are provided for partial subscription periods

  • Refund requests are handled according to Apple's App Store policies

3.5 Subscription Restoration

If you reinstall the App or switch devices, you can restore your subscription using the "Restore Purchases" feature.

4. Acceptable Use

You agree NOT to:

  • Use the App for any illegal purpose or in violation of any laws

  • Upload content that is harmful, offensive, or infringes on others' rights

  • Attempt to reverse engineer, decompile, or hack the App

  • Use automated systems or bots to access the App

  • Interfere with the proper functioning of the App

  • Share your account credentials with others

  • Use the App to collect information about other users

  • Impersonate any person or entity

5. Health and Fitness Disclaimer

Important Medical Disclaimer: ASCEND is a fitness application designed to assist with workout planning and progress tracking. It is NOT a substitute for professional medical advice, diagnosis, or treatment.

5.1 Consult Your Physician

Before starting any exercise program, including workouts suggested by ASCEND, you should consult with a qualified healthcare provider, especially if you:

  • Have any pre-existing medical conditions

  • Are pregnant or nursing

  • Have a history of heart disease or high blood pressure

  • Have musculoskeletal injuries or limitations

  • Are taking medications that may affect your ability to exercise

5.2 No Medical Advice

The workout plans, physique analysis, and recommendations provided by ASCEND are for informational purposes only. They do not constitute medical advice, and we make no claims regarding their effectiveness for any specific individual.

5.3 Assumption of Risk

You acknowledge that physical exercise carries inherent risks, including the risk of injury. By using ASCEND, you assume full responsibility for your health and safety during any physical activities.

5.4 AI Analysis Limitations

The AI-powered physique analysis feature provides estimates based on visual data. These estimates are not medically accurate measurements and should not be used for medical or diagnostic purposes.

6. User Content

6.1 Your Content

You retain ownership of any content you submit to ASCEND, including photos and workout data. By submitting content, you grant us a limited license to use, process, and store this content solely for providing and improving our services.

6.2 Content Guidelines

You are responsible for ensuring your content:

  • Does not violate any laws or regulations

  • Does not infringe on intellectual property rights of others

  • Does not contain malware or harmful code

  • Is appropriate for a fitness application

7. Intellectual Property

7.1 Our Property

ASCEND, including its design, features, content, and underlying technology, is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.

7.2 Trademarks

ASCEND, the ASCEND logo, and ASCEND Pro are trademarks of ASCEND Fitness. You may not use these marks without our permission.

7.3 Feedback

If you provide feedback or suggestions about ASCEND, you grant us the right to use this feedback without compensation or attribution.

8. Third-Party Services

ASCEND integrates with third-party services including:

  • Apple HealthKit: For health data integration (subject to Apple's terms)

  • Google AI: For physique analysis (subject to Google's terms)

  • Firebase: For data storage and authentication

  • RevenueCat: For subscription management

Your use of these services is subject to their respective terms and privacy policies.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • ASCEND IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND

  • WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE

  • WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES

  • OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR ASCEND PRO IN THE 12 MONTHS PRECEDING THE CLAIM

10. Indemnification

You agree to indemnify and hold harmless ASCEND Fitness, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the App

  • Your violation of these Terms

  • Your violation of any rights of a third party

  • Any injuries or damages resulting from your use of workout plans or recommendations

11. Termination

11.1 By You

You may stop using ASCEND at any time. To delete your account and data, contact us at support@ascend.fitness.

11.2 By Us

We may suspend or terminate your access to ASCEND at any time, with or without cause, including for:

  • Violation of these Terms

  • Fraudulent or illegal activity

  • Non-payment of subscription fees

  • Extended periods of inactivity

11.3 Effect of Termination

Upon termination, your right to use ASCEND ceases immediately. Sections of these Terms that by their nature should survive termination will continue to apply.

12. Dispute Resolution

12.1 Informal Resolution

Before initiating formal dispute resolution, you agree to contact us at support@ascend.fitness to attempt to resolve the dispute informally.

12.2 Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

12.3 Arbitration

Any disputes that cannot be resolved informally shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive any right to participate in class action lawsuits.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the App and updating the "Effective Date." Your continued use of ASCEND after changes constitutes acceptance of the updated Terms.

14. General Provisions

  • Entire Agreement: These Terms constitute the entire agreement between you and ASCEND regarding your use of the App.

  • Severability: If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

  • Waiver: Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

  • Assignment: You may not assign your rights under these Terms. We may assign our rights without restriction.
